ADSactly World - 8-year-old girl must repay a loan of dead parents
In 2012, a resident of the Belarusian city of Zhlobin took out a loan for $ 640. The man regularly paid the debt until the day of his death. After that, the bank demanded that the mother and the widow pay the loan. Note that the widow at that time was on maternity leave.
In this case, the women were not guarantors. The man’s mother, Margarita Dmitrievna, paid part of the debt to the bank. The wife due to the difficult material condition contributed money in parts, but died in 2016. The girl Angelina became an orphan, and Zoya Alekseevna, the mother of a woman, became her guardian.
In 2019, IdeyaBank applied to the court, which divided the debt of the deceased spouses equally between the elderly mother of the man and his eight-year-old daughter. By the way, the court allowed the daughter to repay his part of the debt upon coming of age.
“The granddaughter was included in the debtors, because in that old small apartment of the second grandmother, where my daughter and her husband were registered, some measures were left in her inheritance,” explains Zoya Alekseevna.
It should be noted that the guardian grandmother does not want the girl to owe a bank at the age of 18 “for the fact that her parents died”. The woman is determined to appeal the court decision.
The bank wants to return about $ 150. Margarita Dmitrievna is not in a hurry to pay the debt. This is her principled position.
“During the life of my son, I gave him half of the apartment. Now I have to pay for the fact that I inherited a part of this half in my own apartment, which I received from the plant, having worked there 40 years before retirement”, the pensioner explains.
The court did not take into account the physical and financial condition of the mother of the deceased debtor. A woman hardly moves around the apartment and no longer goes out on the street. Her social worker confirmed this information in court.
On the legal side, everything is legal. Each of the heirs is responsible for the debts of the testator within the value of the inherited property transferred to him.
In the absence or insufficiency of inherited property, a credit obligation ceases due to the impossibility of performing, respectively, fully or in the missing part of the inherited property (clause 1 of Article 386 of the Civil Code of the Republic of Belarus). In this case, the loan was insured against default.
On the moral side, the situation looks absurd. The bank is able to forgive a debt of $ 160, given the plight of an elderly woman and a little girl.
From Zoya Alekseevna, Angelina's guardian, the bank received a statement asking for an installment plan for 12 months.
“The bank took into account the situation and satisfied the applicant's request. From Margarita Dmitrievny to the bank no appeals or applications have been received. We are attentive to the appeals received, when making a decision we take into account the objective circumstances set forth by the applicants”, the bank representative commented.
The bank is currently considering this issue based on a court decision. One can only hope that all circumstances will be taken into account, and the eight-year-old orphan and her 83-year-old grandmother will not remain hostage to the circumstances.

The vicious circle.of debt. Instead in Bhagavad Geeta, the most happiest person is the one who does not have any debt. Looking at this case and many instances that came along, I believe each word is true. Debt never allow anyone to live happily untill it got COMPLETELLY repaid.
Feeling sorry for that little girl who is burdening under her father debt. I would say she should be set free considering the loan agreement is between his father and the bank

In most countries, that simple legal procedure would cost more than the debt itself.
Not to mention the potential psychological and emotional consequences.

The bitter reality between law and humanity often seems very strange. In the eyes of law a person can be wrong, but in human values it can be very inhumane. Where the conscience of law and justice makers is. Is not justice intended to humanize humans?
In developing or even chaotic countries power is often used to seize human dignity. So it is fitting that we return to human values. Indeed debt is a debt that must be paid. But there is a human side that must be considered. If all parties, both banks, governments and state managers are able to see with conscience, all matters related to law can be removed in the name of humanity.

I must say that I appreciate and respect very much your posts, @Belarus, because all that I have read so far are very fair and necessary denunciations. In this case, it's completely unfair that a girl and an old woman are forced to pay a debt that was incurred by the girl's deceased parents. Obviously, I don't know the laws or the credit policy of your country, but I do know the human rights, and I can infer that in this case they are being violated. There must be some way to remedy this situation without these two somehow helpless beings being harmed. Thank you for your article on social concern and demand. Greetings.
This is preposterous, and in most civilized countries wouldn't even be legal . . . a minor cannot legally enter into a contract, and therefore cannot be held legally responsible for executing it after the fact.
Whoever these bankers are, this will come back around on them, so I hope that they grow some morals and compassion, or they will clearly be held to accounting other ways.
Ditto the court, which seems clearly bought by the bank, or they would have tossed out the bank's claim against the grandmother and the eight-year-old child as ridiculous.
Otherwise, karma's a bitch, as I suspect they each will learn sooner, rather than later.
@belarus.insider, I will write to the bank personally asking that they set aside this debt, as the moral thing to do, and I encourage everyone who reads this post to do likewise.

I'm reading this post and I really can't believe it! This looks like an absurd, meaningless movie. In which country should a girl take over the debts of her parents, if even they couldn't raise her! How is it possible that an old woman who rather inherited the house to the son, now has to pay for it?! Until recently, Belarus was distant from me, but now that I am getting to know it through its denunciations, @belarus, I feel that we must find a way to denounce and make all injustices, humiliations, come to light and the international community can act.
