Молчание и отсутствие комментариев моего первого поста на данную тему лишь подтверждает тот факт, что правовое регулирование криповалют государством только обретает какие-то формы в виде концепций и обозначения своей позиции.

Газета.ру на данный счет предоставила свои комментарии относительно позиций некоторых заинтересованных должностных лиц.
Так, поясняет портал: «...Обеспокоены в Госдуме также возможностью возникновения финансовых пузырей из-за покупки россиянами биткоинов. «Я раньше стоял на позиции, что не нужно этот рынок регулировать, пусть свободно обращаются, но сейчас вижу, что некоторые россияне могут слишком увлечься покупкой биткоинов и на этом рынке могут возникнуть финансовые пузыри», — выразился один из депутат. ))))...

«Цифровая болезнь» российских чиновников распространилась как эпидемия на пространстве СНГ. Один из обсуждаемых сейчас вариантов регулирования этого рынка — введение налога на заработок от сделок с криптовалютой.

Обеспокоены эксперты и активностью депутатов по регулированию продажи биткоинов. «Технология криптовалют, безусловно, является очень новой и сложной для регулирования», — признает Виталий Цигулев, генеральный директор компании Digital Finance Agency.
По словам сооснователя блокчейн-платформы для управления личными финансами Wirex Дмитрия Лазаричева, регулирование покупки биткоинов в отдельно взятой стране не приведет к должному результату и, скорее всего, вообще вызовет создание черного рынка. По словам Лазаричева, прежде чем регулировать этот рынок, надо дать определение ключевым понятиям, что ЦБ обещал сделать только через несколько лет.

«Сложно регулировать сферу, которая изначально формировалась для того, чтобы этого регулирования избежать», — резюмирует доктор экономических наук Алексей Михеев...."
Таким образом, общую позицию опрошенных можно выразить следующим образом, что сфера оборота криптовалют представляется довольно мутно представителями власти, за исключением специалистов в области технологии блокчейн и экономики.
Более четкую позицию в данном отношении вынуждены оформлять представители Центробанка РФ, что в какой то мере говорит о подходе к критовалюте, как замене действующих финансовых инструментов, и соответственно необходимости осуществления их контроля и регуляции со стороны классических финансовых систем.
Так портал «критовалюты.tech” приводит позицию руководителя рабочей группы при Госдуме по оценкам риска оборота криптовалюты Элины Сидоренко, высказанную ей на митапе IBCG 22 июля, которая поясняет, что российских майнеров обяжут проходить идентификацию при обмене намайненых криптовалют на фиатные средства, однако пояснив, что сам по себе майнинг законодателям не интересен.
«Интерес вызывает не само производство, так как оно не имеет экономической ценности. Майнинг становится интересен в тот момент, когда он становится предметом экономической деятельности», — сказала Сидоренко.
Она считает, что в этом случае майнинг стоит обложить налогом на прибыль, но окончательного решения по этому вопросу еще не принято.
Сидоренко уточнила, что для начала необходимо принять законопроект о криптовалютах, в котором будет упоминаться майнинг. А непосредственное регулирование майнинга будет рассматриваться в следующих законопроектах и нормативных актах.
«Сейчас у нас в России, в виду отсутствия правового определения криптовалют, нет понимания этого явления, потому что оно не является как таковым даже имуществом. Поэтому вопрос о майнинге не стоит. Но если будет определен статус криптовалют, тогда этот вопрос встанет в тот момент, когда лицо, юридическое или физическое, будет выводить это (сферу майнинга) в правовое поле», — заявила Сидоренко.
«Российский майнер будет вынужден вывести это в правовое поле, потому что основная задача заключается именно в том, чтобы в России сделать правильные обменные площадки. Ты можешь производить сколько угодно криптовалюты, но она неинтересна для экономики и для страны до той поры, пока ты не обмениваешь это на фиат. И в этой точке как раз и будет идентификация, так как ты становишься участником реальных экономических отношений. Мы видим очень важным создать лояльные, выгодные условия для бизнеса, для того чтобы он не прятался, а спокойно и с большим интересом пользовался российской юрисдикцией», — добавила она.
Отмечается, что идентификацию майнеры будут проходить в соответствии с общими правилами ПОД/ФТ (противодействие отмыванию денег, добытых преступным путем, и финансированию терроризма), одобренными ФАТФом и Росфинмониторингом. Однако, как планируется заставить майнеров обменивать намайненые криптовалюты именно на площадках с идентификацией личности, пока не решено. ))))...
«Проблема с майнингом заключается в том, что мы терминологически не можем определить границы майнинга, что это такое. Можно ли намайнить дома деньги? Нет. Вы не майните деньги, вы создаете некие вычисления, за которые получаете вознаграждение. Это не производство продукта. Услуга ли это, производство ли это, совместное ли это производство…», — сказала глава рабочей группы.
Эллина Сидоренко также отметила, что государство в целом заинтересовано в создании собственной обменной площадки для торговли криптовалютами....»
Таким образом, от представителя Центробанка РФ, руководителя рабочей группы при Госдуме по оценкам риска оборота криптовалюты до нас доводится информация, что правовое поле как таковое в РФ отсутствует, нет законодательно закрепленных определений термина криптовалюта, и соответственно каких-либо правовых последствий в связи с ее оборотом, а также норм согласно которых осуществляется ее регулирование.
Как мера регуляции рассматривается взимание налога с прибыли при продаже обмене криптовалют на «государственно аккредитованных» площадках, а также идентификация пользователей при выводе средств в фиат. )))....Что также актуально только при наличии обмена на рубли РФ и никак на валюты иных государств, не подотчетных Центробанку РФ.
На данном этапе представители государственных структур признают отсутствие возможности регулирования оборота криптовалюты как действующей децентрализованной системы, однако как только «экономическая деятельность», что неизбежно должно происходить, попадает в поле действия регулирующих актов РФ и Центробанка РФ, возникают вопросы об образовании и ценности которую обретают криптовалюты при обмене на фиатные денежные средства, и как следствие регуляция в виде взимания налогов.
