Legislation Introduced in West Bengal Assembly to Combat Rape
On Tuesday, September 3, 2024, the West Bengal Assembly passed the "Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) Bill 2024" with full support from the Opposition. The bill aims to strengthen protections for women and children against rape and sexual offenses.
Key provisions of the bill include:
Capital punishment for rapists whose actions result in the death or a vegetative state of the victim
Life imprisonment without parole for other rape convictions
- Time-bound limits for the conclusion of investigation and trial in rape cases
The bill was tabled by Law Minister Moloy Ghatak and was passed during a special two-day session of the Assembly, convened following a rape-murder incident at RG Kar Medical College and Hospital. Leader of Opposition Suvendu Adhikari proposed amendments, but they were not accepted by the House.
Chief Minister Mamata Banerjee hailed the bill as a "model" and "historic" legislation, emphasizing the need for stringent laws to protect women and children. She also urged the Opposition to ask the Governor to sign the bill, stating that it is the responsibility of the state government to enact it.
The bill's passage comes amid nationwide protests against rape and sexual violence, and its implementation will be closely watched as a potential model for other states to follow.
