Nintendo enters with process to close two large ROM sites

in #news6 years ago

Nintendo filed a lawsuit against two sites that distributed old nintendo games, calling them "blatant mass infringement of Nintendo's intellectual property rites." Already the site LoveRetro.co, placed offline.

LoveRoms.com has removed all Nintendo ROMs from its site, reports TorrentFreak. According to Nintendo's complaint, both are operated by the same person.

"LoveROMs and LoveRETRO sites are among the most open and notorious online hubs for pirate gaming," says the Nintendo lawsuit filed on July 19 in the US District Court for the District of Arizona. "Through the LoveROMs and LoveRETRO sites, Defendants reproduce, distribute, publicly perform and display an impressive number of unauthorized copies of Nintendo games, all without permission from Nintendo. These include thousands of games developed for almost every video game system which Nintendo has already produced. "

The lawsuit explicitly complains that the sites are a commercial violation, not some fan site or fandom expression.

The defendants conducted their online piracy business in disrespect for Nintendo's rights. Defendants are not casual gamers, but are instead sophisticated parties with extensive knowledge of the intellectual property of Nintendo and the video game industry in general. Defendants know or should know that Nintendo owns the copyrights and trademarks of thousands of games, copyrighted works, and images that appear on Defendants' illicit sites.

The lawsuit asks for damages that could reach $ 100 Million if all the titles are added together. More likely, the size of the damages and the injunctions requested are intended to close the sites instead of recovering any damages. Nintendo also asked for a injunction, giving you control over the domain names.

This is really boobish behavior from Nintendo's side, as far as I can tell. They know they will not get any $$ off of it, just closing the resource. But any company big enough that fighting this is just like fighting windmills.
I've actually been doing some "historical" gaming posts lately, covering noteworthy games released in certain years (just made two about 93 and 2000) and it is perfectly clear that you will not want to bu super old stuff and old systems if you are just a casual gamer, and these ROM sites are just here to keep the legacy going

You're right!!!People who do not have the money to buy the games help spread it by using "pirate" games. It's a stupid extrategia of Nintendo to do this!!!
