Supreme Court of India holds "Triple Talaq" Unconstitutional
SC strikes down triple talaq with 3:2 majority
The honourable supreme court of India has suspended the centuries old practice for 6 months and seeks parliament to legilate on it. This is a big relief for Indian muslim women who have been a victim of this custom.
SC View
Islamic countries have abolished this evil custom and why can't independent India get rid of it.
What is Triple Talaq?
- Talaq-e-biddat is practised by Sunni muslim community of india for past 1000 over years. Once the muslim husband pronounces talaq thrice, the divorce is irrevocable.
- Irony of life is that biddat is considered sin in islam and still triple talaq is permissible.
- Muslim husbands have option to divcorce there wife by triple talaq that is recognized by the All India Muslim Personal Law Board (AIMPLB).
- As per AIMPLB, triple talaq is a matter of faith.
How to divorce your wife?
Simple way to part away for men, just 3 words and it finishes all. When the world is advancing with technology so does this dubious practice. There have been cases surfaced from various muslim women, who have been divorced, and they mentioned that they have been divorced:
- Over phonecalls
- Through WhatsApp and other messaging apps
- Through emails
- Talaq through Rs. 10 stamp paper
A women complained that she came back to her husband's home, after visiting her parents, and her husband did not open the door and uttered the 3 words from inside (sounds insane but this is the condition on ground).
Women empowerment
Indian Muslim women demanded for abolishing polygamy and triple talaq for a long time. There was no significant step taken so far because of the sensitivity of the matter. For a country like India that is so huge and so diverse, superstition can supersede personal freedom; the time is changing, world is changing and people also need to change.
I am sure all women will cherish the SC ruling that holds this evil practice as unconstitutional and seeks proper law to organize this unorganized practice.
I feel, for a country where one of the most powerful prime minister has been a women, this is a moment of awakening. All people should introspect and try to get rid of such evil practices.
