Definición del Bitcoin y las criptomonedas desde el punto de vista legal
El Bitcoin y las criptomonedas se les ha llamado "Monedas Virtuales", pero si nos vamos a un concepto mas aterrizado, realmente no es la denominación correcta, siendo mas acertado el termino, "Medios Digitales de Intercambio". Los juristas que se han adentrado en este tema no las reconocen como monedas por un motivo muy claro, "no son Acuñadas por ningún estado" , y menos cuentan con el respaldo de alguno.
El resultado del uso extendido y la demanda del Bitcoin en el mundo, ha obligado a algunos países a tener que realizar análisis jurídicos, para regular de alguna manera su uso, es así como podemos nombra como ejemplos los siguientes:
En Estados Unidos se le considera como un “bien activo”, no una moneda. La CinFEN (Agencia del Departamento de Tesorería de USA.) denominan al Bitcoin como “Un negocio de servicios de dinero” que tiene un equivalente en la moneda fiduciaria.
En Nueva York, el juez Alison Nathan del Distrito Sur concluyo que: “Los bitcoins son fondos en el sentido corriente de ese término y que pueden ser aceptados como pago de bienes y servicios o comprados directamente en una casa de cambio con una cuenta bancaria. Por lo tanto, funcionan como recursos pecuniarios y se utilizan como un medio de intercambio y un medio de pago”.
En Japón se reconoce oficialmente las criptomonedas como método de pago
La Unión Europea, ha declarado al Bitcoin como una moneda, y no como mercancía, para efectos tributaria.
El Bitcoin ha sido declarado legalmente como activo o mercancía, no moneda, aunque la criptomoneda perfectamente cumple con las propiedades que debe poseer el dinero como son (medio de intercambio, unidad de cuenta y respaldo de valor), su estatuto legal como dinero no está definido en América (norte y sur).

Estos dos ejemplos muestran la realidad actual de la sociedad moderna y de la trasformación que esta sufriendo la economía mundial, ya entramos a la era de la "Criptoeconomia" y podemos desconocer esta nueva era, los países tampoco lo podrán hacer, ni podrán ocultar esta impresionante trasformación del ser humano moderno.
