SLC22-W2 / Branches of Law.
Part I
-. According to what was explained in class, according to the law or laws of your country, indicate two examples of public law and two examples of private law, and explain why you consider that these rights are part of public law and private law.
My country is Nigeria, and in Nigeria which is a nice country to be in, the country's legal system is based on a combination of Islamic law, common law, customary law, statutory law, and English law. The law that governs the relationship between the state and individuals is public law, whereas that which governs the relationship between private entities or individuals in Nigeria is private law.
Public Law Examples in Nigeria
Public Law in Nigeria:
In Nigeria, we have a constitution called the 1999 Constitution of the Federal Republic of Nigeria which is the most supreme law in Nigeria that outlines the structure, powers, and responsibilities of all government institutions and the rights of citizens in Nigeria.
Why public law is important: Public law in Niger is important as it is the law that governs the relationship between Nigerians as citizens and its government, which addresses all public institutions that operate across Nigeria making sure fundamental human rights are been protected.
Criminal Law:
In Nigeria, this is the law that takes care of criminal activities such as penal code, fraud, murder, and so on and if a criminal is been found guilty he or she will be punishable according to the criminal code.
Why it is public law: It is a public law that takes care of criminal activities in a state that prosecutes offenders to maintain public order and as well protect society.
Private Law Examples in Nigeria
Contract Law:
This is the law that is governed by statutes like common law principles, and contract acts in Nigeria. Normally when a contract is signed by two parties disputes can arise which can breach the contract agreement this law is been designed to settle disputes concerning contracts.
Why it is a private law: It is a private law because it regulates obligations and agreements between two parties such as entities or private individuals without involving the state.
Family law:
This is the law in Nigeria that covers matters like divorce, child custody, inheritance, and marriage, which is mostly influenced by statutory and customary laws.
Why is it a private law: It is a private law because it deals with disputes and relationships between persons within family settings not interfering with the interest of states.
-. You must select two laws from your country, you must place them in one of the branches of law explained in class (or with which of the branches of law it is related or similar), and you must also explain why you place that law in that specific branch.
To answer this task appropriately, two laws in my country Nigeria are what I will select and categorize into two branches of law as requested by the professor and as well explain their placement
As we have read earlier, Nigeria is based on the 1999 constitution.
Branch of Law: Public Law (Constitutional Law)
Reason why I place the law:
The constitution in Nigeria is the supreme law and forms the foundation for the operation of the states in Nigeria.
It defines the responsibilities and power of the three arms of government in Nigeria and guarantees fundamental human rights in Nigeria.
The law governs the relationship between states and individuals ensuring accountability and protecting Nigeria's public interest.
The second here is Companies and Allied Matter Act (CAMA, 2020)
Branch of Law: Private Law (Commercial/Corporate Law)
Reason why I place the law:
CAMA is the law that governs the formation, regulations, and management of companies in Nigeria and partnerships and other cooperates entities operating in Nigeria.
It is the law that addresses the obligations and rights of directors, and shareholders.
The law addresses the obligations and rights of directors, shareholders, and creditors in businesses.
Part II
-. Of all the branches of law (explained in class or that you know and have not been explained), which one do you find most interesting and why?
The branch that I find most interesting is Human Rights Law which I will tell you the reason why.
Reasons Why:
I find human rights law interesting because of the following values that it has for every citizen. Talking about the values there are;
Universal Impact: In Nigeria human rights law is a law that focuses on protecting the inherent dignity and rights of individuals regardless of race, religion, and nationality. Another reason is that human rights law is relevant and universal across the world.
Justice and Empowerment: It is a law that serves as a tool to protect common citizens and advocates for justice in Nigeria and other countries.
Dynamic Nature: It is a law that addresses contemporary issues like equality, digital rights, climate and so on which is acceptable in almost every field.
Connection to other laws: It is a law that interacts with international law, constitutional and public law which makes it a world-known law both in Nigeria and outside Nigeria.
Part III
-. We have all had or experienced moments within one of the branches of law. So you must tell us about your own or someone else's experience but of which you have full knowledge and can adapt or compare it with one of the types of law explained in class. You must describe this legal situation in detail and explain why you consider it part of that right.
My Personal Experience Relating to Criminal Law:
Description of the situation
Early this year which was around March 2024, I experienced a burglary and stealing issue at the residence where I was staying. Late at night when everyone in the estate I was staying was busy sleeping, thieves broke into the estate I was staying in and robbed everyone of us. They stole our valuables items such as cash, phones, and laptops, and fled the estate immediately.
The following day after the incident, I and my neighbours in the estate reported the case to the police. We first reported the case to the community vigilantes and they advised us to report the case to the police which we did. After reporting the case to the police they then did an investigation over the matter, and after some time which was about three days later, the suspects were apprehended (caught) and charged with a criminal offense under the Criminal Code act of Nigeria. I later heard that the case was taken to court by the influence of my landlord who owns the estate, where the suspects were then prosecuted by the state.
Why I consider it criminal law
Based on nature of the act, burglary, jumping off someone's fence, stealing someone's property, and threatening the lives of others with weapons like guns, knives, etc to collect their valuables items are classified as criminal offenses under the Nigeria criminal code because it involves violating the law to harm individuals if they didn't surrounded their properties.
Based on the state of involvement, in a criminal law the state ensures that offenders maintain public order which in this case the state the police represent the case whereas I and the other tenants tool up the matter to ensure justice has been served.
Based on punishment since criminal law is to maintain crimes and our societal order, the suspects were prosecuted to face the penalties of the law for their actions and to prevent further harm to others in the community.
