I am excited to be part of this contest, as I had a subject of Law in my university and it is a good opportunity for me to share my knowledge about the laws in my country. Let's get stated!

Part I
-. Say in your own words and based on what was explained in class: What is law?


According to my understanding law is a set of rules and regulations that initiates and balances the relationship between individuals of the society. It ensures order, justice, and uniformity in the functioning of the state. Law is one of the pillars of the state.



Considering the explanations given in class, according to the law and the laws of your country, I pointed out two examples of "Objective Law" and two examples of "Subjective Law".



Every country has different sets of law according to which its state functions and the population has to abide by the laws made by the state. Here are some examples of objective and subject laws in my country Pakistan.

Objective Law:

Objective laws are all the laws that are applied to all the citizens without any biases and everyone apart from their status and race must have to abide by them.

Examples:
Right to Equality:

It states that all individuals are equal under the law and have equal rights. It ensures all the individuals get equal treatment irrespective of their race, class and religion in the state of Pakistan.

Right to Education:

This objective law states that all citizens of the Pakistani state have the right to education. It means every individual has the right to get education.

Subjective Law:

Subjective laws are those that are not applied necessary on all the citizens but these are designed specifically for specific conditions and situations. It can vary from subject to subject and from time to time.

Examples:
Punishment for juveniles:

According to section 14, the law can change the punishment of the juvenile offenders according to the crime they have committed. According to their age the duration of their punishment can be changed.

Defamation:

The defamation law protects the honor and Reputation of every individual in all ways. It means the reputation of each citizen is protected in all the ways in which the context and the intent are determined.

Case study:
A citizen is driving a vehicle on the road and disregards the traffic light. Seconds later he is stopped by a traffic police officer and this citizen claims that he disregarded the traffic light because he was in a hurry to pick up his son and take him to the hospital because he is feeling unwell.
-. Based on what you have learned, please state in which part of the case Objective Law and Subjective Law are present.



In this case study both objective law and subjective laws are present. According to the law every individual should follow the traffic rules and stop at the traffic light when it is red. In this case the driver has broken the objective law and did not follow the traffic rules.
Here the subjective law is present. When the person gave his reason for not stopping at the traffic light, he said that he disregarded the traffic light because he was in an emergency where subjective law becomes active. In this Situation the context, Circumstances and intent of the driver are taken into account of subjectivity.

Part II
-. Based on what you have explained in class, make a comparison and according to the law of your country. Give an example of a law and an example of a norm.



LAW

Law is formal, codified and written rules of the society that are backed by legal authority of the state. Laws are applicable on everyone and when violated there are legal consequences of it such as fines and other punishments.

Example:

Wearing a helmet while driving is a law and disregarding this law can cause you a penalty, as law is reinforced legally.

NORM

Norms on the other hand are unwritten and informal rules of the society. Norms differ from society to society and these are not applicable on all the individuals of the society. norms are made and passed from generations to generations. Abiding by the norms of the society is considered good and mannered.

Example:

Honesty is the fundamental norm of our society. In our society lying is a violation of norms of the society. But it does not involve any legal violation but by doing so you social norms of the society.



Case study:
Mr. Juan Perez rents an apartment but his financial situation is getting worse and he has not paid for 3 months. On one occasion, a meeting of apartment owners was held and the owner of the apartment where Mr. Juan Perez lives brought the case to the attention of the owners of the other apartments. They took the opportunity to say that they have received complaints from the neighbors of the building because Mr. Juan Perez has 4 dogs as pets in his apartment, something that is prohibited in the building's rules of coexistence.
-. Analyze and explain in which part of the case Mr. Juan Perez is violating a law and in which part he is violating a norm.



Law Violated:

According to my understanding in this case study Mr. Juan Perez is violating both law and norms of the society where he is living. He has not paid the rent for the past 3 months. This is something related to the law as he must have done the rental contract with the owner of the house and in this case he is violating that contract by not paying the rent on time. This can also lead him to legal consequences such as a penalty for not abiding by the contract.

Norm Violated:

Every society has certain moms and regulations that every individual of the society should follow. In this case study Mr. Juan has violated one of the norms of the society which is that he kept dogs as pets at home. While it is prohibited to keep dogs at home to which all of them agreed. He might not get any penalty or legal restriction for keeping dogs at home But socially the society does not accept it and here he is violating the norms of the society where he is living.



Part III
-. Explain in your own words what importance Comparative Law has for you according to what you have seen in class.



Comparative law Involves the study of different judicial systems or legal systems around the world. It also gives us the ability to identify and compare laws made in other countries for crimes and acts that are maybe non considerable in our country. And that is the reason comparative law is important because It guides us about the global acceptance of laws and what things are prohibited in other countries around the world. It provides us with a broader spectrum of how legal systems in other parts of the world operate. Due to this spectrum we can compare and improve our own legal and judicial systems.

For example:

Immigration laws in Pakistan are very strict and it does not allow anyone to seek Asylum in any case. Whereas when we compare our immigration law with other laws of the world we can see that most of the developed countries promote and accept individuals that are skillful and could benefit in the betterment of the society. If we compare these laws and make some adjustments in our immigration law, it can help us to attract more skillful people in our country and they can contribute to the development of our country.
