WHAT IS ZERO FIR? HOW AND WHEN IT IS USEFUL?
Police can file FIR( First Information Report) only for the Cognizable Offences.
Offences is of two types :-
Non-Cognizable offence :- These offence are the modest types of offence in which a Police Officer doesn't have the authority to arrest any person without a warrant. In these offences investigation can't be initiated without the order of the court. Example of these type of offences are Simple Hurt, Nuisance, Assault etc.
Cognizable offence :- These offences are the serious types of offences in which Police Officer can arrest any person without a warrant. In these offences Police Officers can start the investigation with or without the permission of the court. Examples of these type of offences are Murder, Robbery, Rape, Grievous Hurt etc.
ZERO First Information Report (FIR) :- With the introduction of the concept of Zero FIR, filling of FIR in police station with appropriate jurisdiction is not necessary. When any women files FIR for the Cognizable offence in such Police station who doesn't have jurisdiction on the area of crime spot, then such FIR is known as Zero FIR. In other words, FIR can be filed in any police station (irrespective of jurisdiction/place of incident) and later same can be transferred to the appropriate Police Station. In Zero FIR no FIR number is given until the FIR is transferred to he appropriate Police Station. The signature of the complainant is necessary on the FIR whether it is zero FIR and must take a copy of it.
When Zero FIR can filed : - The offences like Murder, Rape, Accident can be occurred at any place. There must be the situation that he offence is committed to the place with does't falls under jurisdiction of the Police Station. In such cases delay can't be done as Justice delayed is Justice denied. And without FIR police officers can't do anything. so in such cases with the help of some eye witnesses and the information related to the case you can file FIR of this in any Police Station. No Police Officer can deny to write an FIR by saying that the matter in beyond the jurisdiction of the Police Station.
How Zero FIR can filed : - Same As FIR, Zero FIR can also filed in written or by words. In other words, You can file Zero FIR by giving them the details of offence in written or you can also give them details in oral and the Police Officer writes all the details of offence given by you. You can also request the Police Officers to read the FIR written by them.
SO INDIANS PLEASE AWARE ABOUT IT AND AWARE ALL YOUR KNOWN SO THAT THEY CAN ABLE TO KNOW ABOUT THE LAW AND THEIR RIGHTS.
