I'm from Nigeria a Country in West Africa which is still developing and because of this, things are not stable including the Fundamentals Human rights. Some of the things causing strains on the Fundamental Human rights includes the following.
- Bad Governance
Currently in my Country Nigeria, we have Leaders who are more interested in their Pocket than the Well-beings of the Citizens. Elections are rigged and the wrong people are voted into power, the Citizens are marginalized and oppressed and when the Citizens airs their views, they're locked up in the Prison. For instance there is a man named "Nnamdi Kanu" who has been expressing his views on how innocent Citizens are suffering and he was locked up. This man has been in Jail for several years awaiting trial and they keeps on adjourning his case.
- Police Brutality
The Police and other Security force top priority should be to ensure that the fundamental human rights are respected but the reverse is the case in my Country Nigeria. Before the protest in 2020 in which the Citizens did a peaceful protest because of the Incessant killing and brutality melted on Victims by the Special Anti-Robbery Squad (SARS) innocent Citizens who went to the streets to carry out peaceful protest were killed and several injured and according to Nigerian constitution human beings has the right to peaceful protest.
Another incident that happened and human rights was violated was during the protest organized on the 1st of August 2024 to end bad Governance in Nigeria. Minors were arrested and locked up in Police custody for several months and when eventually they went to Court, they were sentenced to imprisonment with an option of fine. It took the help of some human right activist to rescue this Children. I can go on and on talk about several scenarios in which Human rights were violated in my Country Nigeria.
Please state, according to the laws of your country, whether Human Rights have the same value as the Constitution of your country, whether they are supra-constitutional, or whether the Constitution prevails over international treaties on Human Rights. |

According to my Country Nigeria's Constitution which was enacted on the 29th of May in the Year 1999, it's Supreme over Human Rights. The Chapter Four of the Constitution, talks about the Human Rights which every Citizen is bound to enjoy. Some of them includes.
- Right to Life
- Right to freedom of Movement.
- Right to Vote and be voted.
- Right to freedom of ownership of Properties.
The Fundamental Human Rights being in the Constitution shows that they both have the same aim.

In my Country Nigeria, a Commission known as the National Human Rights Commission ( NHRC). Founded in 1995 is charged with the duty of promoting and protecting Human Rights in my Country Nigeria.
They're charged with the duty of conducting Investigation on Cases involving tortures, killing and violations of Human Rights. They also helps to create awareness and educate people on their Rights.
Other Organizations includes
- Ministry of Justice
- Human Rights Watch

I have witnessed the violation of Human rights severally but the most recent one was the case of a Cleaner that works in my mom's place of Work. So this Woman in question is a Widow and has three Children, two boys and a girl. So the first son is in a Tertiary Institution. So that very day, he was coming home from School when the Police stopped their Bus and asked him to bring his phone and unlock it. He refused and they arrested and locked him up. When his mom went to the Police station where he was detained, they refused her from seeing her son and they leveled so many accusations on this boy. This boy stayed in Police Custody for a Year until a good Samaritan took up his case and he was later released. When he was released, he was a shadow of himself. He was lean as a result of hunger and Torture.
A lady loses her son since he dies in the hands of assailants who take his life to steal his car. The assailants soon after are learned and prosecuted for the murder. You are paying a sentence provided by law. However, the lady considers that they have violated their right to life and decides to file a complaint with the Inter-American Commission on Human Rights. |

The right to Life is one of the most fundamental Human rights in my Country's Constitution, the Constitution places so much importance on Human Life and anyone that takes a Life violates this Law. So in this case, the Victim's Right to Life has been violated and not the Mother of the Victim. So the mother of the Victim is wrong to say that her Right to Life has been Violated. The mother of the Victim no longer have a case to report to the Inter-American Commission on Human Rights since the perpetrators of the Crime has been sentenced to serve Jail term.
A person is detained amid a protest against the government. He is beaten by police officials who kill him. The prosecutor assigned to the case initiates the investigation without being able to accurately identify the perpetrators of this murder. Several years pass, and the victim's relatives turn to the prosecution for a response, and there they tell him that the case was closed due to the fact that it took several years without being able to identify the officials who caused the death.
Say if you consider that both the victim and his relatives are violating Human Rights. Fundament your responses.
We would have to acknowledge the fact that three major Human rights was violated in this case
- First the Right to Life
The victim was tortured to death and his Right to Life was violated.
- Second Right
The Right to freedom of Movement was also violated. This person was unjustly locked up in Police detention.
- Third right
The Right to Justice was also violated in this case. Closing the case without finding the Perpetrators of the crime is also violating the right to freedom of Justice. So in this case, the Victim's who was unjustly killed right to life was violated and the Family who didn't get Justice for their son, their right to freedom of Justice was also violated.
