Based on what was explained in class, state in your own words and with explanations whether you consider that human rights are respected or violated in your country

Human Rights are rights that every human being has since birth as a gift from God Almighty. Included in Human Rights are basic human rights such as civil rights, political rights, economic rights and socio-cultural rights. When talking about human rights, of course, it cannot be separated from the active role of a country. Human Rights are an important part of international law and a moral basis for protecting the dignity and life of every human being. Therefore, Human Rights must be respected, upheld, and protected by the state, government, and every person. Human Rights must be the starting point and goal in organizing life in society, nation, and state.

My beloved country, the Republic of Indonesia, which is the largest democratic country, highly upholds Human Rights for every citizen. The Indonesian government has made various efforts so that every citizen obtains the same rights, obligations and justice for its people. The Republic of Indonesia became independent on August 17, 1945 as the starting point for reforming the levels of national and state life. Various implications are expected to change the Indonesian nation for the better. Although at that time Indonesia was independent, this condition did not immediately accommodate the needs of the state apparatus. At that time, there was no law specifically regulating Human Rights.

Human Rights are a big homework for the Indonesian nation and state. The success or failure of a country is seen from the extent to which Human Rights are respected and fulfilled in that country. The beloved country of Indonesia as a developing country with the largest population is undeniably very vulnerable to Human Rights violations. Social problems in a very diverse Indonesian society make it very possible for Human Rights violations to occur caused by political and economic problems. The problem of law enforcement in Indonesia is still in the learning stage, especially the problem of enforcing Human Rights. However, in general, I can clarify that day by day, the enforcement of Human Rights is getting better and there are no longer any human rights violations in Indonesia today.

Please state, according to the laws of your country, whether Human Rights have the same value as the Constitution of your country, whether they are supra-constitutional, or whether the Constitution prevails over international treaties on Human Rights

The 1945 Constitution of the Republic of Indonesia states that every citizen has the right to freedom. The Indonesian government protects human rights and is more important than international human rights treaties. To uphold Human Rights in Indonesia, the Government has formed a Law that is the basis for enforcing human rights in Indonesia. Law Number 39 of 1999 concerning Human Rights and Law Number 26 of 2000 concerning the Human Rights Court are guidelines for enforcing justice against violations for Indonesian citizens. Enforcement of Human Rights in Indonesia is carried out by establishing the National Human Rights Commission, Human Rights Court, Establishment of Human Rights instruments, Enforcement through laws, to the Establishment of the Truth and Reconciliation Commission.

Mention any organisation in your region that has jurisdiction over human rights. In your opinion, how useful has it been and how has it's operation influenced respect for human rights in your country

In my country, Indonesia, there are several organizations that have the authority to enforce the law and human rights, including: National Human Rights Commission (Komnas HAM). This institution is independent and tasked with supervising the implementation of Human Rights and handling cases of human rights violations. Komnas HAM has the authority to investigate serious human rights violations, and can form an ad hoc team to conduct investigations. Indonesian Child Protection Commission (KPAI), a state institution formed to increase the effectiveness of supervision of the fulfillment of children's rights.

This institution is tasked with supervising, providing input, collecting data, receiving complaints, mediating, and reporting to the authorities. Next there is a government institution Indonesian National Police, an institution that aims to ensure order and law enforcement, and create public peace. In addition, there are also other state institutions that play a role in protecting and enforcing Human Rights in Indonesia, namely the National Commission on Women (Komnas Perempuan) and the Truth and Reconciliation Commission (KKR). These institutions aim to uphold and protect human rights in Indonesia.

Have you or someone close to you been a victim of human rights violations? If so, what was the situation and were you able to assert your rights?

Personally, until now I have never been a victim of human rights violations. I also always pray and hope that I will never be a victim of human rights violations in any form. However, some of my relatives have experienced human rights violations ranging from mild to severe, some even died. The area where I live a few years ago there was a conflict between an organization banned by the state and the government. At that time there were many deaths between the two warring parties until peace was made in 2005. Alhamdulillah, until now peace has been maintained so that there are no more human rights violations in Indonesia.

Part III

Case study 1; Please state whether you believe that the human rights of the victim in this case were indeed violated and whether the complaint to the aforementioned body should be admitted or not. Explain your answers

Every citizen in Indonesia who is a victim of human rights violations, whether minor or serious, has the right to justice. Several victims died during the conflict in my area, including their right to life has been taken away. Although they were not killed, several family members were killed, raising concerns about their safety. Complaints made by each victim must be addressed immediately. This will allow human rights institutions to help protect lives and property. The situation must not be ignored otherwise worse incidents may occur and continue.

Case study 2; Please state whether you believe that the human rights of both the victim and his/her family are being violated. Explain your answers

Based on all the rights mentioned in the lesson, the right to education, the right to work, the right to health, the right to social security, to the right to family protection. All the rights of the victims and their families have been ignored. I believe the rights of the family have been violated. They have the right to social security and protection. Even though all of these things are rights that everyone should have.

There are a lot of cases about violation against human rights in Indonesia and many of those cases are forgotten. Let's not forget why the truth and reconciliation commission is established in Aceh😎 Belated Munir, the missing Wijhi Tukul, the death of Little Sadam in Sp. KKA or Tgk Bantakiyah case in Beutong Ateuh.

Indonesia is a great country that ratified the covenant of human rights and tried hard to carry it on. What do you think about Rohingya's refugees management in Aceh?

It's really refreshing to know that there is minimal and rare cases of human right violation in Indonesia.
