It's High Time Parents Knew And Exercised Their Legal And Parental Rights
Today, let's talk about "RIGHTS", you know those little power every individual is entitled to, actually ain't little. We exercise our rights in so many places, and even a suspected criminal still exercise his rights. Let me paint a scene for you:
Officer: We need to search your house,
Drug-Dealer: Officer what is wrong, do you have a WARRANT?,
Officer: We need to search your house due to a tip we received about you
Drug-Dealer: Come back when you have a warrant!!
Door slams, and police walks away.
That is it, parents have a RIGHT!, numerous in number. If a suspected criminal has rights and stands by them firmly, how much more parents. It is quite unfortunate that parents fail to exercise these rights when dealing with social worker(CPS). The failure of not doing so have either cost them their kids, or lots of court battles and emotional blows. We need to be aware that before any social worker comes into your home for any form of sighting or investigation of your kids, they need a warrant to do so. Whatever the tip or information an informant provided them, they still need a warrant before they can walk through your doors.
About two week ago, I had made an appointment on skype with about thirteen families that had passed through CPS harassment. Only nine kept the appointment, I was surprised as to how many forgot to exercise their rights. Social workers visited about seven without notificationof their coming, and without a warrant, to make matters worst, five let them in without any resistance and preparation and they ended up falling into CPS claws. Only two families stood their ground, assertively saying they can't permit entrance until they have a warrant and they won't speak to them without their attorney being present!. I must say, their case turned out to be much easier.
You are in the best position to talk with a social worker who had been tipped by someone that you abused your child, or whatever the accusation when your attorney is present. It is your right to refuse to make any conversation or answer questions asked. This is where parents still get it all wrong, try as much as possible to always get your attorney on board any discussion.Try not to get a quack attorney who is inexperienced, get someone who has previously dealt with similar cases and has a wining record. Guess what?, the two families that exercise their "Get a warrant" right had the time to prepare and call an attorney before their next visit.
No social worker has the right to talk to your kid without your consent, you have the right to refuse them that access until they have a warrant to do so, most times we give them power to easily crucify us because we wanted to act nice to them. We begin to explain and talk, trying to reassure them nothing is wrong in your home. Nah!, you are giving them the power to crucify you, literally!. Because they will surely try to find something to nail you to a cross by the information you provided. Let me resound this once more, Do NOT invite them in without a warrant!, even if they coerce and threaten you, stand by your decision. This is one of the most important of the perks. Unless they practically force themselves through(they come with an officer most of the time), you can legally sue for that later. Don't act rashly or rudely, be very assertive and politely firm when exercising your Rights, No social worker is a friend!. This is very good advice for anyone who feels the pressure from the CPS.
Simply knowing your rights is sometimes all you need to fend of an attack from legal kidnappers.
Rights & cultures vary from country to country but one thing is universal, family, and protecting families should be societies main concern.

Taken to it's conclusion the only Lawful Warrant (Not Legal) is one discharged by an American Common Law Grand Jury signed by a Justice of the Peace and enforced by a Sheriff operating under Law of the Land which like the Justice of Peace must have been elected by State Nationals, not U.S. Citizens, and the warrant must be specific in the Crime Accused Of and the Place and Things to be searched. Many counties still operate only in an Incorporated Jurisdiction or as a Private Corporation and they have no more authority over you the moment you declare your independence from the U.S. Citizen political status and assert that you are a State National of whatever state is your birth state, a Texan, Floridian, etc, and not a Withholding Agent for the Queen, or a Warrant Officer in the Merchant Marine. Then you can elect a lawful justice system that won't enforce CPS child kidnapping and if they do you recal them promptly with the same power you vested into your justice system to begin with, from the Judge AKA Justice of the Peace to the Peace Officers that were deputized by the Sheriff you elected and the sheriff themselves.

Today I was laughing at the audacity of property tax, not one place on a Government Website that Cites the Law, that obligates anyone to pay property tax. Google was trolling me and put this as my 4th result to the question of "what is the law for paying property tax"

Ha, God, a few years back I spent an inordinate amount of time 'banging' on the doors of offices at our county building including Real Property Tax. When you look at the Deed to your property and find the word Tenant on it, it should raise an eyebrow. It raised my husband and mine and sent us on a journey. I made people nervous with the questions I was asking, to the extent that I was told by the senior employee (her title is eluding me at the moment) of the County Clerk's office that she wasn't talking to me anymore without an attorney.
In the end, no one truly owns their land. Obviously if you can lose it to property taxes, then you are renting it, hence the word tenant. Someone owns it. Just like in the 'days of yore' when land was leased by lords. People use the term slave, but I think indentured servant is closer to what we are.

Along with @baah's great response, I'd also like to add that all of the power CPS workers among others occupying an office and Acting As (fill in the blank), comes from our faith in that power. The moment we stop believing they have power over us is the moment they stop having power over us. They use fear of their illusory authority to trick people. Fear is a powerful tool, but an even more powerful tool is no longer having fear.
Very true @dreemit, their power is a dependent variable, that is why people need to know all this. It is quite eye opening when they come to your home and ask "May i see your kids, would you please let me in" and so many others, all their selection of grammar shows they don't have the authority to, if they did have the authority, they would just do it! and don't ask for your permission. Rather they delude you and you end up conferring authority to them. People need to be aware of all this tricks and plays. Thanks @dreemit

The problem has always been people who are genuinely ignorant of these laws. Just as many people never read the "terms of conditions"
If the terms of the terms have completely different meanings than what you and I then reading the terms only makes you liable lol to having read the terms ;D
It's how we have Maritime Admiralty Courts still pretending to be our Land Jurisdiction Common Law Courts and everyone who is incarcerated is done Lawfully regardless that not anyone having their Due Process since they conveniently and self-serving presume that we agree on the same things and underStand/standUnder their Terms, their Meanings, and why if we point questions at their process, what the nature of the proceedings is, in what capacity are they acting, where is their oath, their bond, what law creates their office, and do it in a way that comes off as genuinely interested and concerned in being lawful we throw monkey wrenches into their schemes.

Our most powerful tool is questioning, simple reasonable questions.
That's an important reminder. I don't know how things work in different parts of the world, but I guess we all have the right to an attorney. Hopefully.
Some of the problem at times is that parents fail to exercise their right. We pre-think they have the legal power to remove any child at anytime, No they don't, getting your attorney on board quickly will atleast prevent them from spewing lies on their reports. Your attorney(experienced) would as well tell you how best to approach them and how best you answer some of their questions to avoid them from exploiting honest loopholes. Yeah true, but most times they tend to want to cut and bury your rights by coercing and threatening your family if you don't give them what they want. Stand your ground when you have to, never ever trust them for a second. Try also not to get arrested, because this people are deceitful. They are wolves in sheep clothing, That is why we need a capable community to back us when we are faced by them. Get an attorney early and remember that you have strength in the numbers behind you, I strongly believe @familyprotection would be that community. So, let's spread the gospel of family protection

Oh, if only my mom new this back in the 80s! Long story short, she spanked our butts with a belt, my brother and I. I found it entertaining at best, as I was a pretty big, tough kid. My brother's teacher caught wind of the "beatings" and CPS was at our house, unannounced, that evening.
The young lady interviewed each of us, then my mom. The result was my mom taking a child abuse mark against her name and we had to go to family counseling.
We deserved every spanking we received, and have become the respectful leaders we are because of mom's discipline. We never received a "beating", though we certainly earned them too.
A request from my mom for a warrant may have resulted in a whole less heartache on her part. I doubt a warrant would have been issued for our case!
