Suing a state is merely impossible. As they'll shield themselves behind various amendments. A lawsuit would be well aimed at county level because they don't have protections.
Otherwise, everyone should sue the CPS. I'll come back tomorrow upvote this with PAL.
Not sure about that, as I have linked a couple of many links I uncovered where CPS was and is being sued, and my understanding is they are state agencies, not county. I say not sure though as in the one link I provided it was the county that paid the settlement, so maybe you are right although the legal argument should* apply to any branch of government.
Right. The state must adopt a plan, based on federal guidelines set forward. When a person sets a suit against, state they'll hide behind 15th amendment. Which will grant them immunity. Not possible without a bar lawyer, even then.. slim. The municipality is what generates income for the state, at a local level. See what i mean? State divides among county DHHS. They have a single and separate unit (CPS) that operates independently.
Well, what I do know is suing CPS is not impossible because people are doing it and winning. I also believe the hospitals and other organizations that fall under the mandated reporting can be targeted as well once you prove they are lying to deny constitutional rights.
Yeah good thought there.. never really focused on that when writing.
