Prof. Statement Yusril related Tanah Waqaf Aceh

If it is a wakaf land handed over by the muwaqif with the intentions expressed for the benefit of the Acehnese, and to the extent that its existence is managed by a Nazi that has changed generations but is still used for its original purpose, then in my opinion the original intention of muwakif must remain in force. This means that the benefit of the land will remain for the benefit of the Acehnese who perform the pilgrimage and other worship. The existence of the people of Aceh can be classified as a unity of indigenous peoples which until now its existence still exist as intended by the 1945 Constitution. At the time waqf vowed, the sultanate of Aceh still exist, then collapsed due to war with the Dutch. RI then stand and Aceh region become part of RI territory. The change of political power in Aceh, in my view, does not abort the muwakif intention and pledge since the beginning that the land that is represented is for the benefit of the Acehnese, regardless of which political power is in power in Aceh. The existence of the Acehnese community as a unit of customary law community that still exists, is clearly stated both in the Law on Nanggroe Aceh Darussalam and in the current Government of Aceh Law. This is the basis of the existence of Wali Nangroe which symbolizes the customs and culture of Aceh. I am now in West Papua. If there is enough time, I will discuss the issue of this wakaf rather deeply, both from the point of view of Islamic law as well as from the legal point of Indonesia. I am ready to help the people of Aceh solve this problem, as in the past I have never been absent from helping the people of Aceh as the direct mandate of Alm Tengku Daud Beureuh to me, as well as the message of my teacher Alm Prof. Osman Raliby.
