True points. Bitfinex checks your IP address. When you login from USA a window pops up to ask if you are in New York. If you say no, then another window asks if you are US resident. If you say yes, then you are limited to certain features of Bitfinex.

EOS said no Americans purely for legal reasons. But, since the Ethereum auction address is public they have no way to keep Americans out.
