Why Is Davos Happing RIGHT NOW?

I wondered why all of the bad guys were hanging out in Davos right now. It seemed odd that they would choose Trump's inauguration day as the day to be in Davos. Then I examined the extradition treaty with Switzerland. Suddenly it's clear as can be! Check it out.

Switzerland’s extradition treaty with the United States outlines circumstances under which Switzerland will not grant extradition. These exceptions are common in international extradition agreements and include:

  1. Political Offenses
    • Switzerland will not extradite individuals for offenses deemed political in nature, such as treason, sedition, or espionage, unless the acts involved violence, such as assassination or terrorist activities.

  2. Military Offenses
    • Extradition is not granted for purely military offenses, such as desertion or insubordination, that do not constitute crimes under civilian law.

  3. Double Criminality Requirement
    • The offense must be a crime in both Switzerland and the U.S. If the alleged crime is not recognized under Swiss law, extradition will not occur.

  4. Risk of Death Penalty
    • Switzerland will not extradite individuals to the U.S. if they face the death penalty, unless assurances are provided that the death penalty will not be sought or applied.

  5. Risk of Torture or Inhumane Treatment
    • If there is a substantial risk that the individual will face torture, inhumane treatment, or conditions violating human rights standards, extradition can be denied.

  6. Offenses of a Fiscal Nature
    • Switzerland is traditionally protective of financial and banking privacy. Offenses solely related to taxation or fiscal matters might not warrant extradition, depending on the specifics of the case.

  7. Nationality
    • Switzerland does not extradite its own citizens under most circumstances. However, it may agree to prosecute its nationals domestically if evidence of the crime is provided by the requesting country.

  8. Statute of Limitations
    • If the statute of limitations has expired under Swiss law for the alleged offense, extradition will not be granted.

  9. Political Bias or Fair Trial Concerns
    • If Switzerland believes the extradition request is politically motivated or that the individual is unlikely to receive a fair trial in the U.S., extradition may be denied.

  10. Proportionality
    • If the punishment for the alleged crime is considered excessively severe relative to the offense, extradition may be refused.

Each request is reviewed on a case-by-case basis by Swiss authorities, often involving judicial review and appeals, to ensure compliance with Swiss law and the treaty provisions.
