Jacob was taken to the hospital where his injuries were evaluated by doctors and social workers took photos of his bruises. The doctors also showed Joshua where there was a clear handprint in his child’s face. Then Jacob’s parents realized who did it…
It turns out that the babysitter they trusted to care for their son had abused their child! They didn’t even think it could be her because they see her as family. Although there is more than enough evidence of abuse, Marbury says the Washington County District Attorney is insistent that the case cannot be prosecuted. Marbury then took to Facebook to try and generate enough outrage from others to see if he could somehow get the prosecutors to change their minds.
An Oregon prosecutor told WTOL 11, “child abuse cases are often very difficult to prosecute, because of the way Oregon law is written. State statute requires a prosecutor to prove beyond a reasonable doubt there substantial pain and serious physical injury to the child, and when there is no witness to the act and the child is too young to say he or she was in pain, the burden of proof is high.”
Marbury’s Facebook post has now been shared nearly 400,000 times since last week and continues to spark outrage from all over the world. Hopefully it’s enough to help this family in prosecuting this babysitter who abused their precious baby boy and to bring peace and closure to this family.
