Indiana Lawmakers Seek To Clarify The Law Surrounding CBD Oil

There is a lot of confusion right now in Indiana over the legality of CBD oil.

In April last year, a bill was passed that legalized possession of CBD for certain patients, those who had treatment-resistant seizure disorders. But the rules didn't declare how they could obtain the product. Because under the new changes, the product was still illegal to sell and possess if you weren't on the proper registry.

Due to the confusion over the matter, various agencies were taking differing approaches to enforcement.

For example, it's alleged that the Indiana State Excise Police had been working to confiscate CBD oil from stores in the state. Meanwhile, other agencies like the Indiana State Police were taking a different approach in that they were considering CBD legal so long as it contained less than 0.3 percent THC.

the Attorney General, Curtis Hill, a few weeks ago in an advisory opinion declared that under state and federal law that CBD oil is illegal. And this decision came despite a great deal of CBD products in the state being sold with little-to-no THC, meaning it doesn't get you 'high'. Yet, Hill says it's still a schedule 1 substance. And the police have already confiscated CBD products from roughly 60 stores in the state.

After the Attorney General declared CBD to be illegal, the Governor of Indiana, Eric Holcomb, recently ordered the Alcohol and Tobacco Commission to cease in their enforcement of CBD oil. The plan was to suspend their enforcement only for 60 days, giving store owners time to sell their supplies, while lawmakers figure out whether or not to legalize.

However, the agency violated that order and sent out letters by mistake to a number of business owners.

Prior to Christmas, the Indiana Alcohol and Tobacco Commission wrongly issued fines to dozens of stores in the state that were selling CBD oil.

Those fines ranged anywhere from $200 to more than $700.

Since the mix-up happened, they've apologized and admitted that they've contacted a number of the business owners, telling them about the mistake. However, their worries might not be over just yet.

Some state lawmakers and enforcement agents want to continue to waste their resources policing a plant that has well documented health benefits, and is being used by millions of people to help treat a wide range of different illnesses.

When it comes to CBD oil, there isn't anything intoxicating or addictive about it. There's no reason to police this substance and to prevent sick people, or anyone for that matter, from consuming it if that is their personal choice.

What are they going to do with all of that oil that they confiscated? Destroy it.

And when you think of the incredible value that the oil could bring to so many people who are suffering and who could use it for remedy to their illness, it's really a damn shame. It's passed the time that people in Indiana, and elsewhere around the world, should be afforded their freedom to possess and consume this product without fear of violence being initiated against them in return.

Rep. Senator Jim Tomes files new bill to legalize CBD oil

A state senator from Indiana has now introduced a bill, just at the end of 2017, that is seeking to legalize both the possession and sale of CBD oil.

This new bill comes only a few weeks after the confusion and mess with the AG declaring CBD oil to be against the law. Now those in the state who need the product, are racing to the store to try and stock up because of the uncertainty about whether or not they will be able to get the medicine that they need. The upcoming effort to clarify the rules over this controversial oil is likely to be one of the key issues for the 2018 session.

This is a shame. I know people who use this for their daughters seizures and it’s sad to know they may have it taken away. I’m from Indiana and can tell you it’s fairly backwards to these types of issues. Heck we still can’t buy beer on Sunday!👎🏻

It is criminal and offensive that CBD oil is schedule one. It has been considered medicine for millennia and still is today. Things need to change.

They are maybe protecting the welfare of big pharmaceuticals and not the people who needs this CBD oil.

Indiana is the home state of Eli Lilly. One of the biggest pharmaceutical companies.

Jeff Sessions just sent a memo saying the US Gov would no longer stay out of states decisions about marijuana legality. This is huge for Colorado and other states where it is legal. Something else to think about with oils!

The US has an opioid epidemic and hemp derived oil is in the spotlight. 😬
