How to Avoid DUI's

in #avoid7 years ago (edited)

You can decline the breathalyzer and field sobriety test if you're not on probation. Also never give consent for them to search your car and never speak to them if they ask questions like, "what were you doing", "where are you going", Just say "I want to remain silent and speak to an attorney" Then they wont have any case against you and you will give your lawyer a much easier job in court. If they arrest you and draw your blood just for remaining silent and not doing the FST, most likely it will be dismissed. Also remember to always film and livestream the encounter.

When you're pulled over, lock the doors and roll up all the windows except yours only 2 inches. That way they can't say they smelled something from the car. If they insist for you to roll your window down, ask them "will you arrest me if I don't?" If they say yes then that would be a false arrest, even if they smell something after you rolled the window the evidence won't be admissible in court because they gave you an unlawful order. If they ask you to hop out the car for their safety, step out and lock the door behind you immediately. Don't answer their questions and decline the FST, if you get arrested and they draw your blood and it has alcohol, your lawyer will be able to dismiss it very easily because they'd have no probable cause to take your blood in the first place. By answering their questions and doing the FST, you will only be helping them build a case against you, because anything you say or do will be used against you and never for you. Remember, it's not the cop's job to be a helpful nice person, their job is to get you charged with whatever bullshit they feel like.

If you livestreamed the whole thing on your cell phone and followed all the other directions, they'd have no reasonable cause to arrest you. They can't smell you, you won't look into their flash light or do their tests, and you won't answer their questions, but they arrest you and take your blood anyway, they will have a very hard time convicting you in court. As long as you didn't get into an accident then it will be dismissed easy. Then after it gets dismissed you can file a complaint against the officer if they treated you unfairly or rudely or illegally.

By the way, this isn't legal advice.
