I don't think this has anything to do with pre-crime. I do think there have been cases of it though... consider drone strikes being used on people who were profiled as "potential trouble-makers" (to quote the FBI's old Counter Intelligence Program memo).

In this case, the judge seems to be considering it illegal to ADVERTISE… which is basically pre-crime.

Well any time the U.S. has performed a "pre-emptive" strike they are doing so with the same mindset as pre-crime. They want to attacker an attacker before they get a chance to attack. They seem to think it's a more honorable excuse for killing people than simply being the aggressor.

Edit: Also, I don't agree... "it wasn’t intended to police what rental hosts upload to the website".
